Payments
Fees for our services are outlined in your individual Service Agreement. Payment terms may include monthly or annual plans based on the scope of work. All fees are non-refundable unless specifically stated in a written agreement. Failure to make timely payments may result in suspension of services.
Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, software, and other materials, is the property of ZenithMedCare and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission from ZenithMedCare.
Partner Integrations
ZenithMedCare may utilize third-party platforms and integrations to deliver services. While we strive to ensure reliable performance, we are not liable for any disruptions, downtime, or errors caused by third-party services or platforms.
Client Obligations
You agree to provide:
- Accurate and complete patient demographic information
- Timely and legible clinical documentation
- Current insurance information and authorization details
- Valid provider credentials and licenses
- Prompt notification of any changes affecting billing
- Secure access to your practice management and EHR systems
Confidentiality & HIPAA Compliance
As a Business Associate under HIPAA, ZenithMedCare is committed to protecting Protected Health Information (PHI). We execute a HIPAA Business Associate Agreement (BAA) with all clients and comply with all applicable HIPAA Privacy and Security Rules. Both parties agree to maintain the confidentiality of all proprietary and confidential information.
SMS & Communication Policy
By providing your phone number, you consent to receive communications from ZenithMedCare, which may include:
- Appointment reminders and service updates
- Account alerts and notifications
- Two-factor authentication (2FA) codes
You may opt out at any time by replying STOP to any message or contacting us at info@zenithmedcare.com. Some essential service messages may still be sent as required.
Termination
ZenithMedCare reserves the right to suspend or terminate your access to our services at any time if you violate these Terms & Conditions. Either party may terminate the Service Agreement with 30 days written notice. Upon termination, we will continue working on pending claims for 30 days and provide a reasonable transition period.
Disclaimer
Our services are provided on an "as is" and "as available" basis. While we strive for excellence, ZenithMedCare does not guarantee specific collection amounts, claim acceptance rates, or uninterrupted service. We make no warranties, express or implied, regarding the suitability, reliability, or accuracy of our services.
Limitation of Liability
ZenithMedCare shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services, including but not limited to lost profits, lost data, or business interruption. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any legal action must be brought in the state or federal courts located in New York County, New York.
Data Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All data collected is used solely for the purpose of delivering and improving our services. For more details, please review our Privacy Policy.
Changes to These Terms
ZenithMedCare may update these Terms & Conditions from time to time. We will notify you of material changes by posting a notice on our website. Continued use of our services after such changes constitutes acceptance of the updated terms.
